Terms of Service

These Terms of Service (the “Terms”), together with any applicable Service Agreement, form a legally binding agreement between you (the “Client”) and Bastant AI AS (“Bastant AI,” “we,” “our,” or “us”) regarding your access to and use of www.bastantai.com (the “Site”) and our services. By accessing the Site or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. Bastant AI reserves the right to modify these Terms at any time. Updated Terms will be posted on the Site. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
1. Client Access and Client Data
We grant you a non-exclusive, non-transferable right to access and use the Site and Services during the agreed term for internal business use by authorized users. Access credentials (e.g., passwords, tokens) will be provided as needed. Unless otherwise agreed in writing, access is limited to five users. You retain all rights to data you upload to the Site. However, by uploading data, you grant Bastant AI a worldwide, royalty-free license to use, store, and process the data solely as needed to provide the Services. Any derivative insights or outputs generated by Bastant AI’s AI systems are the property of Bastant AI.
2. Intellectual Property
All content, code, algorithms, and materials on the Site and within our Services—including but not limited to text, software, visuals, and branding—are owned or licensed by Bastant AI and protected by intellectual property laws.
You may not:
Copy, modify, or create derivative works of the Services or Site;
Sell, sublicense, or distribute any part of the Services;
Reverse engineer or extract source code;
Remove any proprietary notices.
3. Client Obligations
By using the Site, you represent and warrant that:
All registration information is accurate and up-to-date;
You will comply with these Terms and all applicable laws;
You will not access the Site through bots or automation without permission;
You have legal rights to the data you provide;
You have consent (where required) to allow Bastant AI to contact leads or customers on your behalf.
Failure to comply may result in suspension or termination of access.
4. Registration and Account Security
You are responsible for maintaining the confidentiality of your account and password. Bastant AI may revoke usernames it deems inappropriate or misleading.
5. Confidentiality
Both parties may share confidential information as part of the relationship. The receiving party agrees to:
Keep such information confidential using reasonable care;
Not disclose it to third parties except on a need-to-know basis;
Only use it to fulfill the obligations under this Agreement.
These obligations survive termination of the agreement for 3 years unless superseded by a separate NDA.
6. Cancellation
If either party terminates the Service Agreement, the Client is responsible for payment of all services and appointments delivered through the termination date.
7. Prohibited Activities
You may not use the Site to:
Harass or harm others;
Upload viruses or malicious code;
Circumvent security or access restrictions;
Scrape or mine data without authorization;
Impersonate others;
Compete with Bastant AI in an unfair manner.
8. Warranties and Disclaimers
We warrant that our Services will comply with applicable laws and be free of malicious code. Otherwise, the Services are provided “as is.” We disclaim all other warranties, including merchantability, fitness for a particular purpose, and non-infringement.
9. Submissions
Any ideas, suggestions, or feedback you submit become the property of Bastant AI. We may use them for any lawful purpose without acknowledgment or compensation.
10. Privacy Policy
Our Privacy Policy explains how we handle your data. By using the Site, you agree to it. The Site may be hosted in jurisdictions outside your own; by using the Site, you consent to the international transfer of your data. Read our Privacy Policy here: www.bastantai.com/privacy-policy
11. Termination by Bastant AI
We may suspend or terminate your access to the Site at any time, without notice, for any reason, including violations of these Terms. Attempts to create new accounts after termination are prohibited. We may also take legal action if necessary.
12. Modifications and Interruptions
We reserve the right to update, suspend, or remove any part of the Site or Services at any time. We are not liable for interruptions, downtimes, or data loss due to such changes or technical issues.
13. Governing Law
These Terms are governed by the laws of Norway, without regard to conflict of law principles. The parties waive the applicability of the UN Convention on Contracts for the International Sale of Goods.
14. Dispute Resolution
Informal Resolution
Before initiating arbitration or litigation, the parties agree to attempt resolution through informal negotiation for 30 days after written notice.
Binding Arbitration
Unless otherwise excluded below, all disputes shall be settled by arbitration in Oslo, Norway. The prevailing party may recover reasonable legal fees and arbitration costs.
Exceptions
These disputes are not subject to arbitration:
IP enforcement actions
Allegations of unauthorized access, privacy breach, or fraud
Claims for injunctive relief
If arbitration is unenforceable, such disputes shall be settled in Oslo District Court.
15. Data Security and Usage
We employ industry-standard technical and organizational safeguards and commit to GDPR compliance. We only use your data as needed to deliver the Services and do not sell or share it with third parties unless required by law.
16. Data Backups
We perform routine backups, but you are responsible for your own data. We are not liable for any data loss or corruption.
17. Electronic Communications
By using the Site, you agree to receive all communications electronically. This includes contracts, notices, and records.
18. Force Majeure
Neither party shall be liable for delays or failure caused by events beyond their control (e.g., natural disasters, war, strikes, technical failures). Each party shall resume performance as soon as reasonably possible.
19. Entire Agreement
These Terms, together with any Service Agreement and our posted policies, constitute the full agreement between you and Bastant AI. If any provision is found unenforceable, the remainder remains in effect. These Terms do not create any agency, partnership, or employment relationship.
